VegaCast Terms of Service

These Terms of Service set forth the terms and conditions for using VegaCast (hereinafter referred to as the “App”). Users of the App must agree to these Terms before using the App.

Introduction
These Terms constitute a legal agreement between the Developer and the User. By downloading, installing, or using the App, the User is deemed to have agreed to all provisions of these Terms.
Eligibility and Account Registration
To use the App, users must meet certain age criteria (e.g., 18 years of age or older, or if minor, have parental/guardian consent). The responsibility for managing account information rests entirely with the User.
In-App Purchasing and Subscriptions
1. Definition of Right of Use: Functions or items provided through in-app purchases grant a non-exclusive “Right of Use” within the App, rather than ownership.
2. Automatic Renewal: Annual subscriptions will automatically renew every year and the registered payment method will be charged unless cancelled at least 24 hours before the end of the current period.
3. Non-Refundable: All purchases are strictly non-refundable and no pro-rated refunds will be given for partial periods, regardless of the reason.
4. Price Changes: The Developer reserves the right to change subscription fees at any time.
Subscription Management and Cancellation
Users must manage and cancel their subscriptions themselves through their Amazon account settings screen (such as managing subscriptions). Deleting the App or deleting the account does not cancel the subscription.
Prohibited Actions
Users shall not engage in any of the following actions when using the App:
1. Decompiling, reverse engineering, or analyzing the App.
2. Cheating or attempting unauthorized access.
3. Imposing an excessive load on the server.
4. Annoying other users or infringing upon intellectual property rights, including copyrights.
Suspension of Use and Termination of Service
1. Suspension of Use: If a User violates any prohibited action, the Developer may revoke the Right of Use, including subscriptions, without prior notice.
2. Termination of Service: The Developer may terminate the publication (service) of the App. Upon termination of the service, all Rights of Use shall expire, and no compensation will be provided.
Intellectual Property Rights
All copyrights and intellectual property rights concerning programs, designs, logos, text, images, and any other content within the App belong to the Developer.
Disclaimer of Warranties and Limitation of Liability
1. The App is provided on an “as-is” basis, and there is no guarantee that it will be free from bugs or interruptions.
2. The Developer shall not be liable for any damages (including data loss or device malfunction) incurred by the User arising out of the use of the App. Even in cases where the Developer is legally liable, the maximum amount of compensation shall be capped at the total amount paid by the User during the past one year.
Governing Law and Jurisdiction
1. Governing Law: The interpretation, application, and validity of these Terms shall be governed by the laws of Japan.
2. Jurisdiction: Any disputes arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Developer’s place of residence as the court of first instance.
Changes to These Terms
1. The Developer reserves the right to modify these Terms at any time without prior notice to users whenever deemed necessary.
2. The modified Terms shall become effective from the time they are posted within the App or on the website designated by the Developer.
3. The User shall be deemed to have agreed to the modified Terms at the time the User uses the App after such changes take effect.
